ESDC will review the job offer and the labor market after receiving the application to evaluate whether the business has made enough of an effort to find Canadians for the position. A positive LMIA will be issued by ESDC if they find that no qualified Canadians are available to fill the position. They will issue a negative LMIA if they find that there are qualified Canadians available.

Exemptions from LMIA

The LMIA process is not applicable to some foreign employees, including:

  • International trade agreements’ workers
  • professionals in some fields, including academics, researchers, and diplomats
  • Employees in various professions, including farmers and live-in caretakers
  • Canadian citizens or permanent residents’ spouses or common-law partners

Canada Job Bank
